TERMS & CONDITIONS FOR APPLYING FOR THE EXCELLA YOUNG CHEF COMPETITION 2022
1. Introduction
1.1Afternoon Express is a television programme that broadcasts on SABC 3 every Tuesday and Thursday between 17h30 and 18h30.
1.2 The Excella Young Chef 2022 competition (“Competition”) is a reality television competition that will feature selected contenders (“Contenders”) who will compete in cooking challenges (on dates to be determined by the Organisers) between during July and August 2022 (“Competition Period”), that will be televised as part and parcel of Afternoon Express.
1.3 Afternoon Express and the Competition will be produced and conducted by Cardova Trading (Pty) Ltd (‘Producers”) and Wilmar SA Proprietary Limited (collectively “the Organisers”).
1.4 The winner of the Competition will receive a R15 000 cash prize and the 1st and 2nd runners-up will each receive a R5000 cash prize, as more fully detailed in clause 6 below.
1.5 By submitting your application for the Competition, you accept and agree that the terms and conditions as set our herein are binding on you. A copy of these terms and conditions will be available on www.afternoonexpress.co.za.
2. Who can apply
2.1 In order to be considered as a Contender for the Competition, you must: -
2.1.1 have received a culinary qualification from an accredited culinary institution within 24 (twenty-four) months from the closing date for entries of this Competition;
2.1.2 be a permanent legal resident of the Republic of South Africa (“South Africa”);
2.1.3 be 18 (eighteen) years of age or older;
2.1.4 ensure that, if selected as a Contender, you can be fully available to participate in the Competition on any dates and times as may be required by the Organisers during the Competition Period;
2.2 Not be a director, member, partner, employee, agent or consultant of the Organisers, the SABC and or Excella, or any of their holding companies or subsidiaries (collectively “Stakeholders”).
3. How to apply
3.1 Applications for Contenders will be received via the Afternoon Express Facebook or Twitter pages between 5 May 2022 and 12pm on 3 June 2022 (“Application Period”). Notwithstanding the aforesaid, the Application Period may be amended by the Organisers at its discretion without further notice.
3.2 To apply, you must
3.2.1 Go to the Competition post on the Afternoon Express Facebook or Twitter page;
3.2.2 Click on the link and upload a video of you sharing your name, a short intro about yourself, where and when you qualified as chef and describe your Excella signature dish using Excella Longer-grain Rice, Sunflower Oil or Mayonnaise within the Application Period (“Application”).
4. How Contenders will be selected and Auditions
4.1 The Organisers will in their sole discretion select a shortlist of applicants who will be invited for auditions via an online platform on such dates and times determined by the Organisers. The Organisers may at any time at its sole discretion cancel or withdraw an invitation that was sent to an applicant.
4.2 Applicants who are invited for auditions (“Invited Applicants”), will be responsible for own arrangements and or costs (if any) to participate in the online auditions.
4.3 If an Invited Applicant is for any reason unable to attend the audition, he/she will not be considered as a contender and shall have no claim against the Stakeholders.
4.4 The Organisers will at their sole and unfettered discretion select 4 (four) Contenders from the Invited Applicants, who will be invited to participate in the Competition.
5. The Competition overview and determination of the Winner
5.1 The Competition will be filmed at the Afternoon Express studios in Cape Town. Each Contender will be given one hour to create his/her signature dish in the Afternoon Express kitchen and agrees to follow the challenge instructions as determined by the Organisers.
5.2 The Organisers will provide for reasonable transportation and subsistence for the Contenders to participate in the Competition on dates required by the Organisers.
5.3 The Orgaisers will in their sole and unfettered discretion select 2 (two) finalists (“Finalists”) from the Contenders. The Finalists will compete in a further challenge on another date determined by the Organisers within the Competition Period.
5.4 The winner of the Competition (“Winner”) will be determined at the sole and unfettered discretion of the Organisers and will be announced on Afternoon Express during August 2022 (unless otherwise determined by the Organisers). For the avoidance of any doubt, the Winner may be determined by viewer votes if so determined by the Organisers.
6. Prizes
6. 1 The Winner will receive a R15 000 cash prize.
6.2 The Contenders who are determined by the Organizers as the 1st and 2nd runners-up of the Competition will each receive a 5 000 cash prize.
6.3 The Organisers reserves the right to replace the abovementioned prizes with prizes of equal commercial value at its sole and unfettered discretion.
7. By submitting your Application, you acknowledge/agree/submit that: -
7.1 If selected as a Contender herein, you will be available to participate in the Competition, without restriction, on such dates and times determined by the Organisers during the Competition Period.
7.2 You comply with all the conditions for entry as detailed in 2.1 above and you are able to provide any such documents, or other proof, that may be requested by the Organisers to substantiate this.
7.3 All the information included on your Application is true.
7.4 You are not, and shall not at any stage during the Competition be, a member, director or employee of any of the Stakeholders.
7.5 You have no contractual or other legal obligations that may conflict with your Application or participation in Afternoon Express and or the Competition.
7.6 The Contenders, eliminations throughout the Competition and the Winner of the Competition, will be determined in the sole and unfettered discretion of the Organisers. You irrevocably accept and agree that the Organisers’ decisions regarding the aforesaid will be final and you will not challenge same.
7.7 The Competition is sponsored by Excella and, if selected as a Contender, you agree to make use of Excella products as and when required during your participation in the Competition.
7.8 If selected as Contender, you shall not engage in any activities that violate any law, offend against public morals or that reflects negatively on Afternoon Express, or the Stakeholders, compromise the success of the Competition and the Stakeholders’ marketing activities related to Afternoon Express, or embarrass the Stakeholders in any way.
7.9 You agree that the Organisers may use your personal information submitted on your Application, or at any time thereafter to conduct such background checks that may be deemed necessary in their discretion to confirm that you are a suitable candidate to participate in the Competition.
7.10 You acknowledge that the Competition and related activities (e.g. Applications/behind the scenes/profile shoots) may be televised as part and parcel of Afternoon Express and/or as otherwise distributed by the Organisers. You hereby irrevocably assign to the Producer the entire copyright and all other rights of whatsoever nature in and to your participation in and your contribution to Afternoon Express, whether now in existence or arising in the future, including without limitation, the video material submitted on your Application, your performance and/or any comments ascribed to you (whether as part of an interview and/or behind the scenes footage), during your participation in the Competition and/or Afternoon Express and any inclusion of your photographs, likeness, profile, name, voice, sound effect, caricature, literary, artistic and musical materials and the like for purposes of Afternoon Express and/or any related publicity, research and marketing, which the Organisers accept. The Organisers shall therefore be entitled to use, edit, juxtapose, broadcast, re-broadcast, publish or communicate to the public your appearance/performance/participation and exploit and license others to use and exploit such contributions, in the whole or in part, by all means and by all media, manner and formats whether now known or hereafter invented throughout the world and in perpetuity without remuneration or royalties in connection with Afternoon Express or on its own.
7.11 You hereby waive all worldwide moral rights, performers' rights or similar rights (as defined under the Copyright Act 98 of 1978, the Performers' Protection Act 11 of 1967 or in terms of any similar laws of any other jurisdiction) which you may have in your performance/participation.
7.12 Should the Organisers decide not to proceed with the Competition, for any reason whatsoever, the Organisers may in its sole discretion elect to terminate this Application without any liability to you.
7.13 These terms and conditions will be construed, interpreted and enforced in accordance with the laws of the Republic of South Africa.
7.14 You may be disqualified, without compensation, as a Contender or as the Winner, should you, in the opinion of the Organisers, be in breach of any of the terms and conditions contained herein;
8. Confidentiality and what you should do if the media approaches you
8.1 You agree not to disclose to any third party, without the prior written consent of the Producer, any information relating to Afternoon Express/Competition, including, but not limited to, the application/selection process, your appearance in Afternoon Express, behind the scenes happenings, any other Contenders, eliminations, the identity of finalists or the Winner, nor any other information which may come to your knowledge relating to the Stakeholders or their agents, or otherwise in connection with Afternoon Express, save for information which is already public knowledge through no fault of your own.
9. Indemnity
9.1The Stakeholders shall not be held liable and you hereby indemnify and hold harmless the Stakeholders and their employees, directors, agents and representatives against any damage or loss of whatsoever nature arising from your Application or participation in the Competition and/or Afternoon Express. This shall include, but not be limited to, damage arising as a result of travel, illness, injury, accident, death, loss of income, loss of profit, loss or theft of property whilst participating in the Competition.
9.2 You hereby indemnify the Stakeholders, their officers, agents, directors and employees against any costs or damages (including consequential damages and pure economic loss) that may be incurred by the Stakeholders as a result of breach by yourself of your obligations in terms of the Competition.
10. You warrant that:-
10.1 You understand and accept the terms and conditions contained herein and agree to be bound to these terms and conditions.
10.2 you have the legal capacity to send your application and to participate in Afternoon Express and the Competition.
